I. Arrangement

1. Order Regarding Minor Changes to the Land Consolidation Area

(Section 8(1) of the Land Consolidation Act (FlurbG), as amended by the announcement of March 16, 1976 (Federal Law Gazette I, p. 546), last amended by Article 17 of the Act of December 19, 2008 (Federal Law Gazette I, p. 2794))

The area covered by the Lüderitz-Forst BAB A14 land consolidation procedure, as established by the land consolidation resolution of March 29, 2011, and most recently amended by the resolution of April 12, 2024, in the districts of Börde and Stendal, as follows:

The change to the boundary of the land consolidation area is shown on the maps (Sheets 1–3) attached to this amendment resolution.

2. Determination of the Land Consolidation Area

The land consolidation area is designated in accordance with the amendment listed under No. 1.

3. Group of Participants

The owners of the parcels of land added to the land consolidation area are members of the association created by the land consolidation decision of March 29, 2011.
“Participants’ Association of the Lüderitz-Forst BAB A14 Land Consolidation Project”.

4. Temporary Restrictions on Land Use

Notwithstanding any other statutory provisions, the following restrictions apply from the date of publication of the land consolidation decision until the land consolidation plan becomes final:

4.1 Changes to the type of use of the parcels of land may be made without the consent of the land consolidation authority only if they are part of normal business operations.

4.2 Structures, wells, ditches, fences, terraces, and similar installations may be erected, constructed, substantially altered, or removed only with the consent of the land consolidation authority.

4.3 Groups of trees, individual trees, field and riparian woodlands, hedges, fruit trees, grapevines, and berry bushes may be removed only in exceptional cases, provided that such removal does not adversely affect regional cultural interests—in particular, nature conservation and landscape preservation—and with the approval of the land consolidation authority.

4.4 Logging operations that exceed the scope of proper forest management require the approval of the land consolidation authority. Such approval may be granted only in consultation with the forestry supervisory authority.

II. Order for Immediate Enforcement

The immediate enforcement of this administrative act (No. I, 1 through 4) pursuant to Section 80(2), first sentence, No. 4 of the Code of Administrative Procedure (VwGO) in the version dated March 19, 1991 (Federal Law Gazette I, p. 686), as last amended by Article 5 of the Act of October 24, 2024 (Federal Law Gazette 2024 I No. 328), is hereby ordered, with the result that appeals against it shall have no suspensive effect.

III. Notes

1. Administrative Offenses

If changes have been made, or structures have been built or removed, in violation of the provisions of Sections I 4.1 and I 4.2, they may be disregarded in land consolidation proceedings. The land consolidation authority may have the previous condition restored in accordance with § 137 of the Land Consolidation Act (FlurbG) if this serves the purposes of land consolidation.

If interventions have been carried out in violation of the provisions of Section I 4.3, the land consolidation authority must order replacement plantings.

If trees have been felled in violation of the provision in Section I 4.4, the land consolidation authority may order the person who felled the trees to restore the cleared and thinned area to its proper condition in accordance with the instructions of the forestry supervisory authority.

Violations of the provisions set forth in sections I 4.2 through I 4.4 constitute administrative offenses that may be punishable by fines.

2. Right of Entry

Officials of the land consolidation authority are authorized to enter parcels of land for the purpose of preparing for and carrying out land consolidation, and to perform any work on them that they deem necessary.

3. Registration of Unknown Rights

Within three months of the announcement of this decision, any rights that are not apparent from the land register but that entitle the holder to participate in the land consolidation proceedings must be filed with the land consolidation authority, the Office for Agriculture, Land Consolidation, and Forestry (Central Region), Wanzleben Branch, Ritterstraße 17–19, 39164 Stadt Wanzleben-Börde, or the Office for Agriculture, Land Consolidation, and Forestry (Central Region), Große Ringstraße 52, 38820 Halberstadt.

If claims are filed only after this deadline has passed, the land consolidation authority may uphold the negotiations and determinations made to date.

The holder of the aforementioned right must accept the consequences of a deadline that expired prior to the filing of the application, just as must the party for whom that deadline first began to run upon notification of the administrative act.

IV. Interpretation of the Amendment Resolution

One copy each of this amendment resolution, including the reasons for the resolution and the attached maps, will be available for inspection by interested parties for a period of two weeks beginning on the first day of public notice at:

Justification

1. Facts of the case:

The existing land consolidation area, which currently covers approximately 2,686 hectares, will be reduced by approximately 411 hectares as a result of the amendment.

The Executive Board of the Lüderitz-Forst BAB A14 Land Consolidation Association approved the proposed changes to the land consolidation area at its meeting on December 9, 2025.

2. Reasons

2.1 Formal Reasons

This amendment resolution is issued by the Office for Agriculture, Land Readjustment, and Forestry (ALFF) in Mitte, Wanzleben Branch, as the competent land readjustment authority.

The legal basis for the resolution is Section 8(1) of the FlurbG.

The formal requirements for a minor amendment to a land consolidation proceeding have been met.

2.2 Substantive Reasons

Parcel numbers 184/32 and 194 in the Colbitz cadastral district, which were previously included in the adjacent Colbitz BAB A14 land consolidation proceeding, Cadastral District 1, are now being included in the Lüderitz-Forst BAB A14 land consolidation project due to their geographical proximity.

There is no longer any need for land consolidation regarding the parcel to be excluded in the Colbitz cadastral district, parcel 13. The parcel’s continued participation in the land consolidation process is no longer necessary.

The review of the land consolidation proceedings has revealed that, for reasons related to land consolidation and surveying, it is necessary to include the parcels listed under No. I 1 in the Burgstall cadastral district, Parcel 10 in the Burgstall cadastral district, Parcel 8 in the Dolle cadastral district (including Parcel 152 in Parcel 7), and Parcels 9, 10, and 12 in the Lüderitz cadastral district, be excluded from the proceedings. The parcels in question were created through previous parcel subdivisions or the targeted removal of connection points. The exclusion serves to facilitate a more appropriate demarcation and implementation of the proceedings.

The remaining parcels to be excluded in the Dolle cadastral district, parcel 7, consist primarily of land used for agricultural purposes. From an agricultural structural perspective, there is no need for regulation regarding these areas. Nor are they subject to any further planning measures within the framework of land consolidation. Their exclusion results in an appropriate delineation of the project area.

Within the area of the parcels to be excluded in the Lüderitz cadastral district, parcel 13, the “Zehnmorgenteiche” project is in the planning stages; this project is related to the construction of the A 14, VKE 1.4. This involves a planned expansion of the existing Tanger Upper, Middle, and Lower Course FFH site. Excluding these parcels is appropriate given the existing planning intentions, as these areas are not required for the implementation of the corporate land consolidation project.

Further review of the project area in the adjacent zone has revealed that the parcels of land in the Lüderitz cadastral district, parcel 7, are also to be excluded from the project, as this allows for a clearer demarcation of the project area along the L 53.

Overall, this is a minor change to the land consolidation area.
The requirements of Section 8(1) of the Land Consolidation Act (FlurbG) are thus met.

The immediate enforcement of this decision is in the overriding interest of the parties involved. It is particularly in their interest that the continuation of the land consolidation proceedings not be delayed, so that the intended economic benefits can be realized as soon as possible. Conversely, the suspensive effect of potential legal remedies could result in a significant delay in the proceedings, with the consequence that the new parcels of land could not be farmed until one or two years later than planned.

Immediate enforcement is also in the public interest. The measures to improve agricultural and forestry structures, and the public funds invested in them, contribute significantly to the preservation of agriculture and forestry as well as the cultural landscape, and thus to the long-term preservation and enhancement of the competitiveness of agriculture and forestry. In light of the rapid structural change and the need to improve living conditions in rural areas, it is essential that the objectives of land consolidation be achieved as quickly as possible.

The requirements for ordering immediate enforcement are therefore met (Section 80(2), first sentence, No. 4, VwGO).

Information on legal remedies

An objection to this determination may be filed within one month of the first day of its announcement.

If the objection is filed in writing, the deadline for filing the objection is met only if the objection is received by the ALFF at one of the offices listed above before the deadline expires.
