    Directive on the granting of an expense allowance for the honorary arbitrators of the town of Wolmirstedt

    On the basis of Section 5 of the Municipal Constitution Act of the State of Saxony-Anhalt (KVG LSA) in the currently valid version and Section 1 of the Arbitration and Conciliation Act of the State of Saxony-Anhalt (SchStG) in the currently valid version, the guideline on the granting of an expense allowance for the honorary arbitrators of the City of Wolmirstedt is issued.

    1. Purpose of the payment of an expense allowance

    In accordance with these guidelines, the City of Wolmirstedt may grant an expense allowance to arbitrators working in an honorary capacity. This allowance takes into account the expenses of the arbitrators that cannot be covered by the fees to be charged.

    In particular, it serves to compensate for expenses incurred independently of the implementation of arbitration proceedings.

    1. Recipient and amount of the expense allowance
      • 2.1. The recipients of the expense allowance are the arbitrators of the town of Wolmirstedt.
      • 2.2. Upon application, the arbitrators can receive an annual expense allowance of EUR 600.00 as a lump sum.
    2. Conditions of payment of the expense allowance
      • 3.1. The arbitrators can submit a written application for payment of the expense allowance to the City of Wolmirstedt by November 30 of the current financial year.
      • 3.2. The prerequisite for payment of the expense allowance is that
        • the regular conduct of arbitration proceedings and the proper performance of all tasks in accordance with the Arbitration and Conciliation Act of the State of Saxony-Anhalt is guaranteed by the arbitrators,
        • the honorary activities of the arbitrators are not objected to by the Haldensleben Local Court and
        • the fees have been properly settled with the City of Wolmirstedt in accordance with Section 54 of the Arbitration Act.
      • 3.3. The amount of the expense allowance can be reduced or completely refused by the City of Wolmirstedt if the above conditions are not met.
      • 3.4. There is no legal entitlement to payment of the expense allowance. Payment is made depending on the budget funds available in the financial year.
      • 3.5. The application submitted will be reviewed by the City of Wolmirstedt’s Building and Order Department. If an expense allowance is granted, it will be paid out in December of the current financial year.

    Entry into force

    The directive comes into force on 01.06.2025.
