Land consolidation procedure
BAB 14 Samswegen/Groß Ammensleben
In accordance with § 88 No. 3 in conjunction with § 36 Para. 1 of the Land Consolidation Act*1 (FlurbG), the following is issued in the above-mentioned land consolidation procedure
– Provisional Order No. 4 –
I.
As of 01.10.2025, the company responsible (DEGES) will be deprived of ownership and use of the areas used for the construction of the BAB 14 VKE 415/1 (1.1) subsection AS Dahlenwarsleben to AS Wolmirstedt for the relocation points of the 380 kV line of 50 Hertz. The extent of the land restitution and the exact location of the areas temporarily taken up are shown in the attached list of parcels and the ownership regulation maps.
II.
The withdrawal is in favor of the affected owners and users, who will be able to dispose of the areas mentioned under point I again with effect from 01.10.2025.
Property rights are not affected by this order.
III.
The areas used have been properly prepared or recultivated by the company. Local notification of these areas by the company is not required.
IV.
The provisions of this order shall apply, subject to a modifying order, until the provisional transfer of possession pursuant to §§ 65 ff. FlurbG or until the implementation order pursuant to §§ 61 ff. FlurbG.
Justification
The aforementioned land consolidation procedure is a corporate land consolidation procedure with the aim of distributing the loss of land resulting from the new construction of the BAB 14, VKE 415/1 (1.1) subsection AS Dahlenwarsleben to AS Wolmirstedt to a larger group of owners and avoiding the disadvantages for the general state culture caused by the company.
The procedure was ordered by the higher land consolidation authority, the Saxony-Anhalt State Administration Office, with the amendment decision of 01.07.2021. The decision is final.
In a letter dated 26.05.2025, the company owner applied to the Office for Agriculture, Land Consolidation and Forestry (Amt für Landwirtschaft, Flurneuordnung und Forsten Mitte Außenstelle Wanzleben) for the return of the areas temporarily used (VIA areas) as of 01.10.2025.
According to Section 88 No. 3 in conjunction with Section 36 (1) FlurbG, the land consolidation authority is authorized to issue a provisional order if it is necessary for urgent reasons to regulate the ownership and use of land before the land consolidation plan is implemented.
The land temporarily required for construction was made available on the basis of the provisional orders pursuant to Section 88 No. 3 in conjunction with Section 36 (1) FlurbG dated 01.07.2022 and 03.07.2023, taking into account the planning approval documents for the construction of the BAB 14 VKE 415/1 (1.1) Partial section AS Dahlenwarsleben to AS Wolmirstedt
The company operator has now indicated to the land consolidation authority that the land with a temporary claim is no longer required and that the construction work in this area has been completed. The proper recultivation of the land has been completed and checked by the ALFF.
The return of the land required for construction will reduce the land withdrawal for the parties involved and minimize the resulting loss of use. With the possibility of returning these areas to their original and appropriate use, the restrictions on ownership and use caused by the construction of the BAB 14 VKE 415/1 (1.1) subsection AS Dahlenwarsleben to AS Wolmirstedt can also be partially lifted.
For the above-mentioned reasons, it is therefore necessary to regulate the ownership and use of these properties before the land consolidation plan is implemented. This does not conflict with the interests of the affected owners, previous owners or users.
The conditions for issuing the provisional order are therefore met. The application of the company owner is granted.

Information on legal remedies
An appeal against this provisional order may be lodged within one month of notification. The objection must be lodged with the Amt für Landwirtschaft, Flurneuordnung und Forsten Mitte, Außenstelle Wanzleben, Ritterstraße 17-19, 39164 Wanzleben – Börde, or with the Amt für Landwirtschaft, Flurneuordnung und Forsten Mitte, Große Ringstraße 52, 38820 Halberstadt, or with the Landesverwaltungsamt Sachsen-Anhalt, Ernst-Kamieth-Straße 2, 06112 Halle/Saale.
